Procedures for Implementing the Project Participation in the Film Production

  1. The Project’s investment in the film production is conditional on the applicant providing proof of guaranteed funding sources for the film production budget in full, and in any event there shall be no commitment to transfer any part of the investment prior to the execution of an agreement.
  2. The Project must approve all principal personnel involved in the film production, namely, the screenwriter, director, cinematographer and editor. Likewise, the Project must approve the central casting for the film. The filmmakers must adhere to the authorized timetable for production, including commencement and finishing dates.
  3. The Project’s participation in the film production will be authorized for a limited period, in accordance with the timetable stipulated in the contract. Non-adherence to the starting date of the film project (as stipulated in the contract) may lead to termination of the Project participation in a film.
  4. The filmmakers are obligated to adhere to the timetable stipulated in the contract in regard to each stage in the film production, including presentation of the final copy (copy “0”).
  5. Payment installments of the Project’s participation in the film production will be linked to progress of the production in its various stages, and to disbursement of payments, according to agreement.
  6. The Project’s financial participation will be regarded as an investment for all intents and purposes. The Project will be entitled to royalties from the film, deducted on distribution costs (which will receive prior approval), and in proportion to the percentage of its investment in the film.
  7. The Project’s obligation to contribute the approved investment (or any part thereof) to any film production shall commence only upon the execution of a binding agreement between Yad Vashem and the producer and shall terminate six months thereafter.
  8. The films must include, at the beginning and the end of the film, the logo and text provided by the Project, and acknowledge the Project’s partnership in the film’s production in all publications relating to promotion of the film and its distribution.
  9. The filmmaker will provide the Project with a final copy of the film (copy “0”). This copy will remain at Yad Vashem for the purposes of research, education and viewing. Likewise, the project will receive 5 DVD copies of the film.
  10. The Project will be entitled to screen the film at non-commercial screenings at its own discretion, and the filmmaker will not be entitled to any consideration as result of the screenings. The Project will give the filmmaker prior notification of such screenings.
  11. For the avoidance of doubt, nothing in this document shall be deemed as an undertaking of any kind on behalf of Yad Vashem to invest in any film, and Yad Vashem shall not be liable for any damages, financial or otherwise, resulting from the submission or non-submission of an offer, in accordance with this document. Furthermore, this document should not be deemed as exhausting the terms of any contractual relationship between the producer and Yad Vashem with regard to any film and shall not be understood as waiving any of Yad Vashem’s existing or future rights with regard to the film, as shall be determined in accordance with any binding agreement and/or the applicable law.
